Terms of Service for TedGift

1. Acceptance of Terms
By downloading, installing, or using TedGift ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
TedGift is a mobile application that provides:
- AI-powered gift recommendations
- Gift search history and tracking
- Calendar integration for gift reminders
- AI-generated caricature creation
- Credit-based system for premium features
3. Account Registration
To use TedGift, you must:
- Be at least 13 years of age
- Create an account using Google Sign-In or Apple Sign-In
- Provide accurate and complete information
- Maintain the security of your account credentials
You are responsible for all activities that occur under your account.
4. Credit System and In-App Purchases
4.1 Credits
TedGift uses a credit-based system for premium features:
- New users receive 10 free credits upon registration
- Credits can be purchased through in-app purchases
- Credits are consumed when using AI features (gift suggestions, caricatures)
- Credits are non-refundable and have no cash value
4.2 In-App Purchases
Available credit packs:
- Starter Pack: 20 credits
- Basic Pack: 50 credits
- Popular Pack: 100 credits (bonus included)
- Premium Pack: 200 credits (bonus included)
- Ultimate Pack: 500 credits (bonus included)
- Mega Pack: 1000 credits (bonus included)
Important: All purchases are final. Credits cannot be refunded, exchanged, or transferred between accounts. Pricing is subject to change.
4.3 Payment Processing
Payments are processed through:
- iOS: Apple App Store (subject to Apple's terms)
- Android: Google Play Store (subject to Google's terms)
We use RevenueCat for subscription and purchase management. By making a purchase, you agree to their terms as well.
5. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Attempt to reverse engineer or hack the App
- Share, sell, or transfer your account
- Upload inappropriate, offensive, or copyrighted content
- Abuse or exploit bugs for unfair advantage
- Use automated tools (bots) to access the App
- Violate any applicable laws or regulations
6. AI-Generated Content
6.1 Content Ownership
AI-generated content (gift suggestions, caricatures) created through TedGift is provided "as-is" for personal use only. You retain ownership of content you create, but TedGift is not responsible for:
- Accuracy or appropriateness of AI recommendations
- Quality or likeness of AI-generated caricatures
- Any copyright or intellectual property issues arising from AI-generated content
6.2 User Responsibility
You are responsible for:
- Ensuring uploaded photos comply with our policies
- Obtaining permission before creating caricatures of others
- Using AI-generated content responsibly and legally
7. Camera and Photo Library Access
By granting camera/photo access, you confirm:
- You own or have permission to use the photos
- Photos will be processed temporarily for AI features
- We do not permanently store uploaded photos on our servers
8. Push Notifications
By enabling notifications, you consent to receive:
- Gift reminders
- Event notifications from your calendar
You can disable notifications at any time in your device settings.
8.1 Error Monitoring and Data Collection
We use third-party error tracking services (Sentry) to monitor app stability and performance. By using TedGift, you consent to the collection of:
- Technical error information (crash reports, exception logs)
- Device information (model, OS version, app version)
- Anonymized usage patterns leading to errors
- Performance metrics
Error data is retained for 30 days and then automatically deleted. You can request immediate deletion by contacting us at nas91dev@gmail.com.

8.2 Third-Party Services
TedGift uses the following third-party services that may collect data:
- Supabase (authentication and data storage)
- RevenueCat (in-app purchases)
- OpenAI/Google AI (gift recommendations and AI features)
- Sentry (error tracking and monitoring - 30-day retention)
- Apple Sign In / Google Sign In (authentication)
Each service has its own privacy policy and terms of service.
9. Privacy and Data
Your use of TedGift is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.
10. Intellectual Property
TedGift and its original content, features, and functionality are owned by TedGift and are protected by international copyright, trademark, and other intellectual property laws.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:
- Uninterrupted or error-free operation
- Accuracy of AI-generated recommendations
- Compatibility with all devices
- Availability of third-party services (Google, Apple, Gemini API)
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEDGIFT SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Purchases made based on AI recommendations
- Issues arising from third-party services
Maximum liability is limited to the amount you paid for credits in the past 12 months.
13. Account Termination
13.1 By You
You may delete your account at any time via Settings → Delete Account. Upon deletion:
- All your data is permanently removed
- Unused credits are forfeited (non-refundable)
- You cannot re-register with the same email
13.2 By Us
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the App or other users
14. Refund Policy
All credit purchases are final and non-refundable.
For iOS purchases, refund requests must be made directly to Apple through the App Store. For Android purchases, contact Google Play support. TedGift does not control or process refunds.
15. Changes to Terms
We may update these Terms from time to time. Significant changes will be communicated via:
- In-app notification
- Email (if provided)
- Updated "Last Updated" date
Continued use of the App after changes constitutes acceptance of the new Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.
17. Dispute Resolution
Any disputes arising from these Terms or use of TedGift shall be resolved through:
- Informal negotiation first
- Mediation or arbitration if negotiation fails
- Jurisdiction in Bulgarian courts
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
